Background / Decision Summary:

In January 2023 Executive made the decision to proceed to public consultation on a draft CIL charging schedule following preparation of the supporting evidence base. A public consultation was undertaken in February and March 2023 following which responses were considered resulting in further viability testing. This post-consultation work informed a revised draft charging schedule reflecting the updated viability evidence. Consultation on this took place at the end of 2023 and into 2024.

 

Further work to update the viability assumptions was undertaken following the adoption of York’s Local Plan in February 2025 to ensure that the evidence is still relevant. Where changes were necessary, these have been combined into a Statement of Modifications. In accordance with Regulation 19(4) of the Community Infrastructure Levy Regulations 2010 (as amended), the Council has notified of the modifications made to the original charging schedule and commenced a 4 week consultation wherein people can register their views and whether they wish to be heard on the matters changed at the independent examination.

 

This decision is to submit the draft CIL charging schedule and supporting documentation for examination as per Executive’s decision in January 2023:

(iii)     That authority be delegated to the Corporate Director of Place [now Director of City Development], in consultation with the Executive Member for Finance and Major Projects, to consider the representations made to the consultation, to make any relevant modifications, and then submit the draft CIL Charging Schedule (and supporting documents) for examination by an independent Examiner.

The council has appointed an independent Programme Officer to oversee the CIL Examination process and act as a conduit between the Council and independent Examiner. An independent Examiner has also been appointed to undertake the Examination.

 

Subject to this decision and submission, it is anticipated that a hearing session for the Examiner to hear matters from representors will be scheduled in September 2025.

 

Options Considered:

        i.        To agree/ not agree to submit the revised CIL Charging Schedule for examination.

 

Options Rejected:

        i.        To not agree submission of the revised CIL Charging Schedule for examination – As noted above, Executive decided in January 2023 to progress to adoption of CIL. Work has been delayed pending adoption of the Local Plan but all appropriate evidence has now been produced to support submission of the draft CIL Charging Schedule. Subject to the proposed modifications and further consultation detailed, the delegation in place from January 2023 now supports submission for examination.

Consultation Process:

Previous stages of consultation on the draft CIL Charging Schedule have taken place in Spring 2023 and Winter 2023/4. A final 4 week consultation on the proposed modifications is underway until mid August. In accordance with Reg19 of the CIL Regulations (as amended) comments in this will be limited to the modifications proposed and whether they wish to be heard on this matter at Examination.
